NDIS Review Flowchart|Lifelong Pathways

NDIS Review Flowchart: Due to the complexity of the NDIS Review of a Reviewable Decision process, Lifelong Pathways has devised an NDIS Review flowchart to help clarify the process.  Attached  is the NDIS Review Flowchart.

There are three main options:

  • Review of a Reviewable Decision
  • External Review to the Administrative Appeals Tribunal (AAT)
  • Complaint to the NDIA

Review of a Reviewable Decision

The first question to ask yourself is: “Are you satisfied with the NDIA’s decision?”  If the answer is no, then it may be possible to submit a Review of a Reviewable Decision.  However, the decision has to be one that can be reviewed, and there are criteria for this.  Please refer to Section 99 of the NDIS Act, found at the following link:

Another key factor is that the Review of a Reviewable Decision needs to be submitted within three months of the date the decision was made.  Once the application has been submitted you then need to wait for the NDIA to make their decision.  They may request further information or discuss aspects of the appli

cation with you in order to assist them to make their decision.  Please refer to the NDIS Review Flowchart for a visual representation of this.

External Review

If you are not satisfied with the outcome, you then have the option to submit another review.  This is an External Review Application, and  the decision is made externally to the NDIA.  The application is submitted to the Administrative Appeals Tribunal and must be done so within 28 days of the Review of a Reviewable Decision outcome from the NDIA.  This process can be lengthy, and may involve case conferences at the AAT.  If conciliation cannot be reached then the case will progress to a hearing.  This involves panel members appointed by the AAT to hear both sides and to then make a decision.  This is also clearly represented in the NDIS Review Flowchart.

Complaint to the NDIA

There is also a complaints process.  A person can submit a complaint to the NDIA at any time, irrespective of whether or not a review process is occurring.  For more information on the NDIS complaint process, please refer to the NDIS website:
